Day One Incident occurs, disciplinary action taken (suspension or IAES)
Day One Notify parent
Day One If disciplinary action equals ten days or less of suspension (cumulative total for the year),
no other action required.
Strong recommendation: review IEP and services, including behavioral
interventions and antecedents in order that modifications may be identified
to reduce likelihood of behavior repeating.
If disciplinary action for weapons and drugs involves more than ten days and up to maximum of 45 days placement in IAES,
Schedule functional behavioral assessment ASAP, if one has not been
done previously. Send assessment plan to parent for signature.
If functional behavioral assessment and behavioral intervention plan exists,
alert IEP team to review them.
Schedule IEP meeting to occur no later than ten business days from Day
one. Notify parent of IEP meeting at least 48 hours prior.
If district intends to expel,
Notify parent by letter of intent to conduct pre-expulsion assessment.
Schedule assessment with specialists to be completed by day ten.
Schedule IEP meeting to occur no later than ten business days from day
one. Notify parent of IEP meeting.
By Day Ten If discipline action consists of more than ten days, hold IEP
meeting to
Determine interim alternative education setting.
Develop functional behavioral assessment plan or review existing functional
behavioral assessment and behavioral intervention plan.
Make manifestation determination.
If behavior is a manifestation of disability, student's placement
at time of incident can be changed through IEP process. District may request
an expedited hearing to attempt to change placement. Court order may be
requested, but FAPE must continue.
If behavior is not a manifestation, student may be disciplined the
same as general education student, but FAPE must continue.
After Day Ten If behavior is not a manifestation, and district intends to expel, district may commence board expulsion hearing only if pre- expulsion assessment and IEP meeting have been completed. Follow required notifications and procedures in California Ed Code.
